Judge Maryellen Noreika of Delaware District deserves recognition for her refusal to partake in the Hunter Biden/Justice Department spectacle, raising concerns about its legitimacy and postponing her decision on the approval of any plea deal between Biden and federal prosecutors. 

The case against Hunter Biden, the first son of a sitting U.S. president to attempt pleading guilty to federal crimes, has sparked questions about the fairness and transparency of the Department of Justice and our entire justice system. 

Hunter Biden sought to plead guilty to two misdemeanor tax charges while evading prosecution on a gun charge and drug use allegations. This diversion from felony charges is a legal tactic that most Americans would never have the opportunity to employ if found guilty of similar crimes.

Despite closed-door discussions, both legal teams disagreed on the full extent of the plea deal and whether it would shield Hunter Biden from future prosecution for other crimes. This suggests that the Department of Justice reconsidered granting immunity to Hunter Biden for potentially more serious criminal activities in response to public outcry and scrutiny.

During my time as a federal prosecutor, the DOJ focused on prosecuting the most serious crimes with solid evidence and imposing lengthy prison sentences. Prosecutors should be investigating potential corruption, racketeering, and violations of laws like the Mann Act and FARA. I have been discussing the existing evidence of a possible pay-to-play scheme involving Biden, his family members, and business associates for years.

The case against Hunter Biden, the first son of a sitting U.S. president to attempt pleading guilty to federal crimes, has sparked questions about the fairness and transparency of the Department of Justice and our entire justice system. 

The recent testimony of FBI and IRS whistleblowers during a congressional hearing, along with revelations of additional criminal behavior, likely increased pressure on the DOJ to pursue further charges against Hunter Biden. In essence, the DOJ was caught red-handed, and the only way for Americans to demand government accountability is to maintain this pressure.

Unfortunately, the DOJ lacks significant checks and balances, and for decades, they have operated under the belief that they can control charging and sentencing decisions without consequences. Prosecutors arrogantly believed they would reach a resolution without facing any repercussions, but the backlash across the country has put them on notice.

This behavior by the DOJ raises valid criticisms of both Attorneys General Bill Barr and Merrick Garland. During their tenures, it appears that the DOJ prioritized protecting the Biden family over rooting out corruption.

Most American families understand that they would not receive the same treatment as the Bidens. While it remains to be seen whether Judge Noreika’s court will modify or dismiss this sweetheart deal, we must insist on a thorough investigation of additional crimes by a Special Counsel empowered with the authority to bring charges and explore all evidence regarding decades of alleged criminal activity involving Hunter Biden, his family members, and associates.
