This law has the potential to greatly expand access to telehealth for individuals seeking abortions, particularly those who reside in states with restricted abortion care. The bill provides protection to providers by stating that New York officials will not assist any state with an abortion ban that attempts to take legal action against a New York telemedicine provider offering abortion services to a patient living in a state with a ban.
Providers will be shielded from out-of-state litigation as long as they operate in compliance with New York law, as detailed in the bill. Speaker of the New York House Carl Heastie, a Democrat, stated, “As anti-choice extremists continue to erode reproductive care nationwide, New York remains a sanctuary state for access. It is our moral duty to aid women throughout the country in exercising their bodily autonomy by safeguarding New York doctors from legal efforts by anti-choice extremists. Telehealth represents the future of healthcare, and this bill is a vital step towards ensuring the protection of our healthcare professionals.”
This legislation has the potential to expand access to medication abortions, particularly in states where access is severely limited. According to a study by The New York Times, 14 states have imposed complete bans on abortions, while others have implemented gestational restrictions on the procedure.
Medication abortions, which involve the use of two different medicines (mifepristone and misoprostol) and can be administered at home, currently account for over half of all abortions in the United States, according to a report by the Guttmacher Institute.
Assemblymember Karines Reyes, a Democrat, expressed her pride in sponsoring this significant legislation as a medical professional. She stated, “I am fully dedicated to protecting abortion providers who utilize telemedicine. I have deep concerns about the efforts of anti-choice activists to hinder doctors’ ability to adequately care for their patients and interfere with patients’ autonomy over their own bodies. These anti-choice measures have a tangible negative impact on patients’ health and well-being, and New York is determined to take a stand against them.”
The bill now awaits the approval of the Democratic Governor of New York, Kathy Hochul.
