Baldwin had initially faced two counts of involuntary manslaughter, but they were dropped earlier this year due to the emergence of new information that required further investigation and analysis. The prosecutors emphasized that dropping the charges did not absolve Baldwin of potential criminal culpability, and charges could be refiled in the future. Baldwin maintains his innocence, claiming that he never pulled the trigger and was unaware that the prop gun contained live ammunition. He has filed a lawsuit against Gutierrez-Reed and other members of the film crew, alleging negligence for allowing him to handle a loaded gun without his knowledge.

The forensics report includes detailed descriptions and images of the gun and cartridges, along with still images of Baldwin handling the revolver on set. Observations of these images suggest that Baldwin’s finger was near the trigger while cocking the gun. According to Lucien Haag’s report, the trigger had to be pulled with approximately 2 pounds of force in order for the gun to discharge. The only alternative explanation would be if the trigger was already pulled or held in a rearward position while retracting the hammer. Haag did not mention any modifications to the gun, although some parts had been replaced for the examination.

It is important to note that Baldwin’s attorney has not yet responded to CBS News’ request for comment on the report.

Overall, this new forensics report adds weight to the allegations against Baldwin and raises the possibility of charges being filed once again. The investigation into the incident on the set of “Rust” continues, and the trial is scheduled for December.
