Meadows Files Motion to Transfer Georgia Case to Federal Court

Former White House chief of staff, Mark Meadows, has become the first to attempt to have his Georgia indictment moved to federal court. In a court filing on Tuesday, Meadows’ lawyers argued that the charges against him should be dismissed promptly in federal court due to state interference in a federal official’s duties. The charges stem from Meadows’ work as former President Donald Trump’s chief of staff. According to his lawyer, Meadows is entitled to a federal immunity defense. The filing cited the “removal statute,” which permits officials facing state prosecution to move the case to federal court if it relates to their duties.

Meadows, like the other 18 defendants, is facing charges of racketeering. Additionally, he has been charged with soliciting an official to violate their oath of office. This pertains to a phone call he set up in which President Trump pressured Georgia Secretary of State Brad Raffensperger to find more votes. Despite the charges, Meadows denies any wrongdoing, claiming that actions such as contacting state officials on the President’s behalf and setting up phone calls are not inherently criminal.

The filing stated that it is expected for a Chief of Staff to the President of the United States to engage in such activities. However, some legal experts argue that interfering with election results does not fall within the normal duties of any federal official. Meadows is the first to request a shift to federal court, but others, including Trump and former Justice Department official Jeffrey Clark, are anticipated to follow suit.
