McDonald’s Faces Another Hot Coffee Lawsuit: A Closer Look

An 85-year-old woman in San Francisco has recently filed a lawsuit against McDonald’s over a hot coffee incident. Mabel Childress claims that she suffered “severe burns and emotional distress” after purchasing coffee at a drive-through in June. The coffee spilled on her because the lid was not properly sealed, as reported by KTLA. Childress still experiences pain and has scarring in her groin area months later. She also stated that the restaurant employees refused to provide her with any assistance after the incident.

Dylan Hackett, Childress’ attorney, shared with the Washington Post that his client went to the emergency room after being ignored for an hour. However, the restaurant owner, Peter Ou, denies the allegations and claims that his staff promptly offered assistance when informed about the incident. Ou emphasized that his restaurants strictly adhere to food safety protocols, including ensuring the proper sealing of hot beverages. Childress is seeking more than $25,000 in damages from the lawsuit filed against McDonald’s Restaurants of California.

This is not the first time McDonald’s has faced legal action over hot coffee-related incidents, as reported by Insider. The restaurant chain gained infamy with the infamous 1994 case involving Stella Liebeck, a 79-year-old woman who received a $2.9 million jury award after suffering third-degree burns from spilled coffee, covering 6% of her body. Liebeck eventually settled for $500,000. Another similar lawsuit was filed by Joan Fino, a 74-year-old woman, in California back in 2013, which was settled for an undisclosed amount, according to ABC30. Butch Wagner, Fino’s attorney, stated that McDonald’s franchises often keep the coffee excessively hot to prolong its freshness, saving around $1 million daily.
