Marine’s Family Lawsuit Against Baldwin Dismissed.

Alec Baldwin has been cleared of a $25 million defamation lawsuit brought against him by the widow and sisters of a Marine who died in the 2021 suicide attack at Kabul’s airport. After the attack, Baldwin donated $5,000 to the family of Lance Cpl. Rylee J. McCollum. The lawsuit was filed after the actor discovered that Roice McCollum, the Marine’s sister, had participated in the protest before the Capitol riot and referred to her as an “insurrectionist.” However, US District Judge Edgardo Ramos determined that certain comments made by Baldwin, including calling Roice McCollum a “rioter,” were private messages and others were protected by the First Amendment. The judge has given the family until Sept. 12 to submit an amended complaint. An earlier lawsuit filed in Wyoming was dismissed due to the actor’s New York residency.

A defamation lawsuit against Alec Baldwin, initially dismissed in Wyoming, has been refiled in New York. The widow and sisters of fallen Marine Rylee McCollum accuse the actor of making false accusations against them, including labeling Roice McCollum as an “insurrectionist.” Baldwin made this statement after she posted a photo of protesters in Washington on Jan. 6, 2021. A federal judge previously dismissed the suit, stating that the court lacked jurisdiction since Baldwin is a resident of New York. The family is seeking $25 million in damages, claiming that Baldwin’s accusations caused emotional distress.

Following the Marine’s death at Kabul International Airport last August, Baldwin made a donation of $5,000 to the family, according to the Hill. Roice McCollum participated in an election protest and shared a photo in January to commemorate its one-year anniversary. Baldwin saw the post and reposted the photo on his Instagram account, referring to her as an insurrectionist. In the refiled lawsuit, it is emphasized that Roice McCollum had no involvement in or support for the Capitol attack that occurred on the same day. In response to Baldwin’s remarks, she commented online, stating that protesting is legal.
