Man’s Request for Re-Sentencing Denied in Long Beach Resident’s Murder Case

A state appeals court panel has dismissed the re-sentencing request made by one of the two men who pleaded guilty to the murder of a Long Beach man. The victim was shot because of the expensive “spinner” rims on his car. The three-justice panel from the 2nd District Court of Appeal upheld the decision of a Los Angeles County Superior Court judge, who determined that Jamar Cornell Nunally played a major role in the carjacking and exhibited reckless disregard for human life. Therefore, Nunally is not eligible for resentencing. This ruling follows a petition for re-sentencing filed by Nunally under a new state law applicable to certain murder cases.

In March 2006, Nunally pleaded guilty to second-degree murder in connection with the killing of Ryan Groetken on May 19, 2003, outside an apartment building in Hollywood. Although he later attempted to withdraw his plea, Nunally was sentenced to 15 years to life in state prison. His co-defendant, Dane Woodson, pleaded guilty to first-degree murder and received a sentence of 35 years to life in prison.

The appellate court ruling from 2007, which affirmed Nunally’s conviction, reveals that Woodson shot Groetken in the back after both he and Nunally confronted the victim, demanding the keys to his Lexus. In response to the demand, Groetken stated that he was “not going to die over this.” Additionally, a third individual assisted in the theft of the Lexus and pleaded guilty to being an accessory after the fact, resulting in a four-year prison term.
