Federal Trade Commission Chair Lina Khan, who recently faced a setback in her attempt to block Microsoft’s acquisition of Activision, is now facing a grilling on Capitol Hill. Members of the House Oversight Committee, namely Jim Jordan and Nancy Mace, are leading a panel that will question Khan on a range of issues, including alleged mismanagement of staff, a burdensome merger review process, and harassment claims after Twitter’s acquisition by Elon Musk. A memo obtained by The Post outlines these concerns, describing Khan’s actions as a waste of agency resources and an advancement of a “woke agenda” in corporate America. The memo also highlights a decline in morale among FTC staff, with only 36% reporting motivation due to FTC management in 2022, down from 80% in 2020.

Additionally, the memo accuses Khan of resisting congressional oversight, citing her refusal to provide relevant documents regarding the FTC’s investigation of Twitter. There are also claims that Khan may have wrongfully coordinated with foreign regulators and Democratic allies like Sen. Elizabeth Warren. The UK regulatory agency CMA has confirmed multiple interactions with the FTC regarding the Microsoft-Activision case, raising concerns about the sharing of confidential information. While Khan denies any collusion, skepticism remains.

While the Activision case and potential collusion may be touched upon, they are not expected to be the main focus of the questioning. It was previously reported that Rep. Jordan intended to hold hearings investigating Khan’s conduct.
