A lawsuit has been filed against the city of Beverly Hills on behalf of a young girl from Newport Beach who suffered a chin injury after falling on a shallow light post at the Beverly Canon Gardens in 2022.
The lawsuit, filed in the Santa Monica Superior Court, also names Maybourne Beverly Hills Operator LLC as a defendant. Maybourne Beverly Hills Operator LLC is the company responsible for managing and overseeing the Beverly Canon Gardens. The lawsuit alleges negligence and premises liability, as well as a dangerous condition of public property. It seeks compensatory damages and reimbursement for medical expenses.
In the lawsuit, it is claimed that the lighting fixture on the light post had several spikes on top, posing a potential skewering hazard and an unreasonable risk of harm. The suit argues that the fixture’s low height made it difficult for visitors to see, thereby increasing the likelihood of accidents. It describes the lighting fixture as a “dangerous trap.”
A spokesperson for Beverly Hills did not provide an immediate comment regarding the lawsuit, which was filed on September 5th.
The plaintiff, who is now 8 years old, was 6 at the time of the incident on August 14, 2022. The lawsuit includes photos of the injured girl and the lighting fixture.
The suit states, “As the plaintiff was walking near the fountain in the garden, she fell into the short and spiky light fixture, causing severe injuries to her face.”
The lighting fixture was located in a planter next to the central fountain of the garden. The lawsuit claims that the defendants were aware that visitors, especially young children, would be attracted to the fountain. Therefore, it argues that it was vital for the defendants to ensure the area was free from hazards. The suit contends that the defendants failed to either remove the fixture or place a barricade with a warning around it.
The girl is said to still be incurring medical expenses, including hospital and nursing costs, as well as suffering a loss of time and income, according to the lawsuit.
