Legacy admissions: Unfairness beyond the City Council’s purview

Following the Supreme Court’s ban on racial preferences in college admissions, lawmakers in the city, as well as Albany and Capitol Hill, are now advocating for new legislation to prevent similar favoritism towards applicants with family connections to schools.

An introduced bill in the Legislature aims to prohibit colleges from inquiring about an applicant’s parents’ alma mater, enforcing a substantial fine on schools that violate this ban. Last week, the City Council voted in favor of urging state lawmakers to pass this law.

Interestingly, the council is taking a stand against real and blatant unfairness, although some critics argue that lawmakers may be going too far with this legislation.

Indeed, legacy admissions, like racial preferences, are deemed unfair. Critics view it as “affirmative action” for the privileged and well-connected, highlighting the unfairness of admitting individuals with connections to a school over more qualified candidates who lack such advantages.

However, imposing stringent laws on the actions of private entities appears excessive to us.

Colleges consider a multitude of factors in their admissions process, many of which can be deemed “unfair.” It is not the place of lawmakers to second-guess these decisions.

Racial preferences, on the other hand, are distinct. As ruled by the Supreme Court, they are unconstitutional and violate federal regulations for schools receiving federal funding, which applies to most institutions.

Moreover, these preferences contradict a fundamental US principle: no individual should endure discrimination based on their race, regardless of the reason.

Although it is heartening to see the City Council and other lawmakers addressing a genuine issue, the reality remains that it is beyond their jurisdiction.
