Lawyers Representing Harvey Weinstein’s Accuser Seek Access to Producer’s Financial Records

Attorneys representing a former model/actress who claims to have been sexually assaulted by Harvey Weinstein in a Beverly Hills hotel room in 2013 are seeking access to the producer’s financial records in anticipation of a potential award of punitive damages.

The plaintiff, referred to as Jane Doe No. 1 in the lawsuit filed on February 9 in Santa Monica Superior Court, alleges charges of sexual battery, false imprisonment, negligence, and intentional infliction of emotional distress. On Thursday, Doe’s legal team submitted court documents to Judge Elaine W. Mandel, requesting permission to examine Weinstein’s wealth.

“Given that there is a strong likelihood, if not a near certainty, that Plaintiff Jane Doe 1 will succeed in her claim for punitive damages against Weinstein, she should be allowed to gather information about Weinstein’s financial situation,” argue Doe’s attorneys in their court filings.

On December 19, Weinstein, aged 71, was convicted of three out of the seven criminal charges he faced, including forcible rape, forcible oral copulation, and sexual penetration by a foreign object. All three of these counts are related to Doe, with the offenses having occurred on or around February 18, 2013. Weinstein was subsequently sentenced to 16 years in prison on February 23.

“To put it simply, Weinstein’s criminal conviction conclusively establishes his liability for Jane Doe 1’s claim of sexual battery, thereby entitling her to pursue punitive damages against him, which she seeks,” further argue Doe’s legal representatives in their court documents.

Weinstein’s lawyers previously filed a response to the plaintiff’s complaint, asserting that the claims made by Weinstein’s accuser are barred by the statute of limitations and that her demand for punitive damages is unconstitutional. They argue that the lawsuit should be dismissed.

According to Doe’s lawsuit, she attended a film festival and alleges that Weinstein unexpectedly entered her hotel room after her participation in the day’s events.

“After he assaulted her, he acted as if nothing unusual had happened and left,” claim the plaintiff’s legal filings.

Doe did not report the incident until 2017, when she had a conversation with her daughter amidst the prominence of the #metoo movement, during which Weinstein was a prominent figure, according to court documents filed by her attorneys.
