Lawsuit Resolved: Market Chain Allegedly Exploited Controversial ‘Caking’ Tradition to Justify Employee Termination

A former assistant manager for Superior Grocers has settled his lawsuit against the supermarket chain. The lawsuit alleged wrongful discharge, retaliation, failure to prevent retaliation, and a violation of the California Family Rights Act. The terms of the settlement were not disclosed.

In previous court papers, it was stated that the parties had agreed to arbitrate the plaintiff’s claims instead of litigating them. The arbitration proceedings were scheduled to begin in November.

The attorneys for the company denied the allegations and cited various defenses, including the statute of limitations.

The plaintiff, Ronald Parada, was hired in 2012 and advanced through the ranks to become a store director. The suit alleges that during his employment, it was a tradition for employees to celebrate birthdays and other occasions by “caking” each other.

Parada had complained about excessive work hours and reported labor code violations. He also raised concerns about inaccurate time records and employees not receiving sick pay. He took medical leave multiple times, including after being injured in a car accident and after the death of his father.

In February 2021, Parada was fired, allegedly for “caking” two female workers. The lawsuit claims that the store’s explanation for his termination was a pretext for his protests and requests for family leave.
