The Los Angeles Unified School District is facing a lawsuit from an adult woman who claims she was sexually abused by her high school English teacher. In response, the district has taken legal action against the teacher, Barry Smolin, seeking to share any fault found by a jury.
The woman, known as Jane Doe, filed her lawsuit in April 2021, naming both the district and Smolin as defendants. However, her attorneys dropped Smolin from the case in July, and the trial against the LAUSD is scheduled for September 12.
In a complaint filed with the Los Angeles Superior Court on Friday, the LAUSD requests a fair division of fault between the district and Smolin. The district argues that it should be entitled to an equitable contribution from Smolin based on his proportionate degree of fault.
A representative for Smolin was unavailable for comment at the time of writing.
According to Doe’s lawsuit, Smolin allegedly began grooming her during her freshman year at Hamilton High School in 2006-07. As part of this process, he gave her a CD of music he had made.
The grooming continued throughout Doe’s sophomore and junior years, with Smolin reportedly telling her he adored her and that hugs between them were “mandatory.” The sexual abuse began during Doe’s senior year in the 2009-10 school year, as stated in her lawsuit.
The suit also alleges that another teacher walked in on one occasion while Smolin was sexually abusing Doe, prompting him to abruptly push her away. Furthermore, Smolin allegedly provided Doe with alcohol and drugs, including marijuana and salvia, in order to maintain their inappropriate relationship.
Additionally, Doe claims that Smolin gave her $300 to purchase LSD, encouraging her to sell it for a profit. The lawsuit contends that she has suffered humiliation and emotional distress as a result of the alleged abuses.
