Lawsuit Filed Against Hooters in North Carolina Alleging Discrimination

Hooters, the popular restaurant chain known for its “Hooters Girls,” is currently facing a lawsuit in North Carolina. The lawsuit alleges that one of its locations in Greensboro engaged in discriminatory practices when recalling employees after the COVID-19 pandemic. Specifically, the lawsuit claims that employees with Black or dark skin tones were not given the same opportunities as their White counterparts.

In March 2020, the Greensboro Hooters had to lay off more than 40 employees due to the pandemic. When the restaurant began recalling employees in May 2020, it allegedly prioritized White employees or those with light skin tones, leaving out a significant number of Black and dark-skinned employees.

The Equal Employment Opportunity Commission (EEOC) supports these claims, stating that before the layoffs, more than half of the Hooters Girls were Black or had dark skin tones. However, after the recall in May, this number dropped drastically to only 8%. The EEOC also alleges that employees with dark skin tones faced racial hostility and witnessed preferential treatment of White employees at the restaurant.

The lawsuit highlights the importance of employers conducting objective and unbiased selection criteria when recalling employees from a layoff. It emphasizes that federal law protects employees from race-based decisions in all aspects of employment, including layoffs, recalls, and hiring decisions.
