Lawsuit Filed Against Burger King Regarding Whopper Burger

A US judge has ruled that Burger King must face a lawsuit accusing the company of deceptive practices by misrepresenting the size of its Whopper burger on the menu. The class action lawsuit alleges that the fast food chain displays the burger with a larger patty and overflowing ingredients on the menu, whereas the actual serving size is significantly smaller. According to the lawsuit, the Whopper appears to be 35% larger with more than double the meat than what is actually served to customers.

Burger King has denied these allegations, claiming that it is not obligated to deliver burgers that exactly match the picture. US District Judge Roy Altman believes that the jury should determine the perception of reasonable people. However, he dismissed claims that Burger King misled customers through its television and online advertisements.

Following the ruling, a Burger King spokesperson stated, “The flame-grilled beef patties shown in our advertising are the same ones we use in the millions of Whopper sandwiches served to our guests nationwide.”

On its website, Burger King describes the Whopper as “the burger to rule them all” with a “real meaty” beef patty and other ingredients.

In addition to Burger King, other fast food chains such as McDonald’s and Wendy’s are also facing similar lawsuits in the US, alleging unfair and deceptive trade practices.

The lawsuit also accuses McDonald’s and Wendy’s of featuring burgers in their marketing materials that are at least 15% larger than their actual size.

Earlier this year, Taco Bell faced a similar lawsuit alleging that their pizzas and wraps contained only half of the advertised filling.

A Burger King spokesperson responded to these claims, stating that they are false.
