Kesha and Dr. Luke reach settlement in defamation lawsuit surrounding rape allegation: “The truth remains known only to a higher power”

Kesha and Dr. Luke have reached a settlement in their defamation lawsuit, which they jointly announced. This settlement brings an end to their nearly decade-long legal battle surrounding Kesha’s accusation that Dr. Luke, also known as Lukasz Gottwald, drugged and raped her in 2005. Dr. Luke has consistently denied these allegations and claimed that Kesha defamed him.

In an Instagram statement, Kesha said, “Only God knows what happened that night. As I’ve always stated, I cannot fully recall everything that occurred. I am eager to close this chapter in my life and embark on a new one.”

“I wish peace for all parties involved,” Kesha added.

In his statement, Dr. Luke reiterated that nothing took place and expressed that he settled for the sake of his family.

“While I appreciate Kesha acknowledging that she cannot fully recall what transpired that night in 2005, I am completely certain that nothing happened,” said Dr. Luke. “I never drugged or assaulted her, and I would never engage in such behavior. For the well-being of my family, I have vehemently fought to clear my name for nearly a decade. It is now time for me to put this arduous matter behind me and move forward with my life.”

“I wish Kesha the best,” he added.

Kesha filed a lawsuit against Dr. Luke in 2014, alleging that he drugged and raped her nine years prior, as well as subjected her to psychological torment throughout their working relationship. She claimed that he harassed her about her weight, belittled her voice, and abused his authority to manipulate her career.

In response, Dr. Luke countersued Kesha, asserting that she made completely false and deeply damaging statements in an attempt to tarnish his reputation and break her contractual obligations.

Kesha also countersued Dr. Luke under a New York law that prohibits the filing of frivolous lawsuits as a means of intimidating critics into silence. New York’s highest court recently ruled in her favor, allowing her to pursue these claims.

In addition, the court recognized Dr. Luke as a “public figure” under the law. This distinction is significant because proving defamation is more difficult for public figures than for ordinary individuals.

Previously, lower courts had determined that Dr. Luke was not a public figure. Several media outlets and organizations became involved in the case to argue that those prior rulings could potentially enable prominent individuals to suppress free speech and hinder reporting on allegations of sexual abuse.

Earlier in the proceedings, Kesha was ordered to pay Dr. Luke over $373,000 in interest on royalties she had delayed in paying for several years.
