According to the family’s attorney, a young Black father and his baby were pepper-sprayed by police in Kenosha, Wisconsin while they were eating at an Applebees restaurant. The officers were searching for a hit-and-run suspect and mistakenly targeted Jermelle English Jr. and Shayna Boyd, who were not involved in the incident.

Video footage of the incident, obtained by The New York Post, shows the officers holding English down while someone pleads for a bystander to help with the baby. One of the officers can be seen striking English near his head multiple times. Despite their lack of involvement, English and Boyd were charged with disorderly conduct, resisting arrest, obstructing an officer, and possession of marijuana for Boyd.

The family’s attorney has called for an investigation by the Justice Department and for the charges against English to be dropped. The incident has left the family feeling unsafe due to their race and has sparked demands for accountability.

Tanya McLean, the executive director of a local social justice nonprofit, has criticized the police for not releasing all body camera footage of the incident. The press conference addressing the incident coincided with the third anniversary of the police shooting of Jacob Blake in Kenosha, which further highlights the ongoing issues with police misconduct in the area.

The Kenosha Police Department has not responded to Insider’s request for comment at this time.
