Justice Department in a tough position as plea deal is rejected by Hunter Biden

President Biden’s Justice Department is facing scrutiny following developments during Hunter Biden’s court appearance. Hunter Biden’s plea deal fell through, and he pleaded “not guilty” while federal prosecutors confirmed that he remains under investigation. Originally, the president’s son was expected to plead guilty to two misdemeanor tax counts to avoid jail time on a felony gun charge.

Critics are now directing their criticism towards the Justice Department. Mike Howell, director of the Oversight Project at the Heritage Foundation, believes that “something is rotten in the state of Delaware, and the judge sniffed it out today.”

During the court hearing, Judge Maryellen Noreika questioned federal prosecutors about the investigation and the possibility of future charges against Hunter Biden. The prosecutors confirmed that he is still under active investigation but did not disclose any specific details. In response to the question about a potential FARA violation, federal prosecutor Leo Wise confirmed that the DOJ is still investigating Hunter Biden in this regard.

Paul Kemenar, counsel for the National Legal and Policy Center, finds it absurd that after a five-year investigation, misdemeanor charges are the best the prosecutor could come up with and considers it a slap on the wrist. Judicial Watch President Tom Fitton goes even further and believes that the development should at least lead to an impeachment inquiry targeting Attorney General Merrick Garland.

Ultimately, Hunter Biden pleaded not guilty because Judge Noreika could not accept the plea deal as it was presented. She expressed concerns about the constitutionality of the diversion deal related to the felony gun charge. If Hunter Biden were to breach the deal, the judge would need to make a finding of fact before the government could bring charges.

It remains to be seen if a new plea deal will be agreed upon. The situation has raised questions about the ethics within the DOJ and has also increased the urgency for an impeachment inquiry targeting not only Hunter Biden but also Attorney General Garland.
