Judge Finds Trump’s Attempt to Delay E. Jean Carroll Trial Unconvincing

A federal judge delivered a scathing 17-page opinion on Friday, rejecting former President Donald Trump’s attempt to delay the trial in writer E. Jean Carroll’s defamation case against him. U.S. District Judge Lewis Kaplan in Manhattan responded to Trump’s request to postpone the trial while he appeals a previous ruling. Kaplan deemed Trump’s appeal “frivolous” and refused to change the scheduled trial date of January 15, 2024.

In his request, Trump presented arguments that were “unpersuasive” and essentially repeated the ones he had previously made in denied requests to delay the trial, Kaplan stated. The judge also highlighted that Trump failed to meet the necessary criteria for staying the trial, including providing evidence that his appeal has a reasonable chance of success and showing that proceeding with the case on schedule would cause irreparable harm.

Kaplan further noted that Trump’s delay in claiming presidential immunity in the lawsuit, which Carroll initially filed in 2019, worked against him. By waiting for several years before raising the immunity defense and another seven months before moving to stay the case based on that defense, Trump effectively forfeited any claim to irreparable harm resulting from having to stand trial.

Trump failed to address the court’s reasoning in rejecting his argument and did not present any reasons for the court to believe that he will succeed on appeal, Kaplan added.

Carroll’s defamation lawsuit revolves around her allegations that Trump defamed her when he dismissed her claims of rape, suggested she fabricated the attack for book sales, and stated she wasn’t his type.

It’s important to note that this lawsuit is separate from the one that recently went to trial, where a Manhattan jury found Trump liable for sexually assaulting Carroll in a department store dressing room in the 1990s, resulting in a $5 million damages award.

Kaplan also dismissed Trump’s defamation countersuit against Carroll earlier this month, determining that she had the right to express on CNN that Trump raped her.
