Important Update: Conditional Settlement Reached in Girl’s Abuse Suit against Teacher, One Year Anniversary Today (September 28, 2022)

One Year Ago Today (September 28, 2022)… A tentative settlement has been reached in a lawsuit involving allegations of molestation against a former district teacher. The lawsuit was brought on behalf of one of several girls who were reportedly molested by the teacher, who has since been sentenced to prison.

The lawsuit, filed in August 2018 in Los Angeles Superior Court, claimed that Jose Cruz Martinez molested the plaintiff, known as Jane Doe, during the 2017-18 school year when she was 12 years old. On July 26, the girl’s attorneys informed Judge Kevin C. Brazile of a “conditional” settlement and stated that a request for dismissal would be filed by Jan. 11.

The complaint, filed by the girl’s guardian against the district and Martinez, asserted charges of sexual battery, sexual harassment, negligence, intentional infliction of emotional distress, and negligent infliction of emotional distress.

Martinez, who taught second grade at Rowland Elementary School, is accused of molesting the girls on campus between Aug. 1, 2017, and April 1, 2018.

The plaintiff states in her suit that she was 7 years old when the abuse occurred.

Martinez, then a 54-year-old resident of Rowland Heights, was sentenced in 2018 to five years in prison following allegations of inappropriate touching.

The lawsuit alleged that “Martinez abused his position of authority to repeatedly engage in inappropriate sexual conduct with Jane Doe…” Most of this misconduct took place on school grounds and in the classroom, with other administrators and staff present, according to the complaint.

In addition to inappropriate touching, the suit claimed that Martinez painted the girl’s nails and gave her gifts and treats.

The lawsuit also alleged that the district knew or should have known about Martinez’s previous misconduct with other students.

In response to the lawsuit, the district’s lawyers denied any liability on their client’s part and filed a cross-complaint against Martinez seeking indemnity.
