Homeowner detained for attempting to remove squatters from his residence

A homeowner arrived at his suburban Atlanta property only to find himself arrested for trespassing. Tim Arko had pulled into his desirable Decatur home after the previous tenant moved out, only to be confronted by a stranger brandishing a gun. Arko quickly fled the scene and called 911 to report the intrusion. However, to his shock, he was the one arrested and taken into custody. Arko has been embroiled in a legal battle to evict the alleged squatters ever since.

Located near the coveted East Lake Golf Club, Arko’s recently renovated home has been occupied by the squatters for six months. Tragically, two individuals have lost their lives to drug overdoses during this time. Furthermore, code enforcement has cited Arko for failing to maintain the property he cannot access due to the squatters. Although an eviction order has been signed after protracted court delays, Arko is still patiently waiting for the marshals to conduct the eviction, with hopes of it happening in September.

Arko’s attorney, John Ernst, voiced his frustration with the broken court system favoring trespassers and criminals rather than innocent victims like his client. The situation is reminiscent of a similar incident in May, where an Army officer returned from active duty to find a squatter, Vincent Simon, illegally residing in her $500,000 residence. Despite Simon’s criminal record and refusal to vacate the property, law enforcement claimed it was a “civil matter” and declined to intervene.

Lt. Col. Dahlia Daure, the victim of this intrusion, expressed her sense of violation, stating that she would have been home had she not been serving her country. Frustrated by the inability to take matters into her own hands while abiding by the law, Daure longed to retaliate against the squatter. Her 4,300-square-foot home, which she had renovated at an additional cost of $35,000, is now caught in legal limbo.
