Georgia Supreme Court denies Trump’s motion in election probe

Former US President Donald Trump, who is also a potential candidate for the 2024 Republican Presidential nomination, made a futile attempt to quash a special grand jury report. This report recommended criminal charges in the investigation of Georgia’s 2020 election by Fulton County district attorney, Fani Willis. However, the Georgia Supreme Court unanimously dismissed Trump’s bid. The court also rejected his request to bar Willis from overseeing the criminal investigation.

The ruling comes ahead of Willis’s plan to seek indictments related to Trump’s efforts and those of his allies to overturn President Joe Biden’s victory in Georgia. As of now, no one has been charged in this investigation and the identities of the individuals recommended for prosecution by the grand jury remain undisclosed.

The state’s highest court stated that Trump’s attorneys failed to prove that this case warrants bypassing lower courts, as it does not present exceptional circumstances. Trump’s legal team also has a similar pending request in Fulton County Superior Court to block the grand jury’s work and report. In their petition, they claimed that the evidence obtained by the grand jury was unlawfully obtained.

In its dismissal, the Supreme Court clarified that a petitioner cannot circumvent the ordinary channels for relief without demonstrating unfair access to those channels. Trump’s dismissal does not prevent him from pursuing other legal avenues.

The investigation conducted by the special grand jury in 2021 included the examination of evidence and testimony from numerous witnesses. Recently, regular superior court grand juries were empaneled to determine whether Trump and his allies should face criminal charges.

The criminal investigation by DA Fani Willis began after Trump’s publicized phone call urging Georgia’s Secretary of State to manipulate the vote count. This was part of Trump’s broader effort to reverse his defeat in the Electoral College or cast doubt on the election results.

It is worth noting that Trump is currently facing charges in two other criminal cases. In a New York state court, he pleaded not guilty to falsifying business records related to a hush money payment in 2016. In a Florida federal court, he also pleaded not guilty to charges regarding the retention of classified records after leaving the White House.

Additionally, Jack Smith, the special counsel in the classified records case, is separately investigating Trump for possible crimes related to his attempts to reverse the 2020 election outcome and his involvement in the January 6, 2021, riot at the US Capitol, where his supporters stormed the building during a joint session of Congress. Trump remains a key contender for the 2024 Republican presidential nomination.
