Georgia Emerges as the Most Dangerous Indictment among all Charges against Trump

Donald Trump is once again facing potential legal trouble, this time in Georgia. Fulton County district attorney Fani Willis is said to be finalizing her grand jury to indict Trump, as well as several of his 2020 campaign advisers, for their attempts to overturn the state’s election results. While Willis and Manhattan District Attorney Alvin Bragg may both be Democrats, Willis’s case appears to carry more weight than Bragg’s questionable charges. Unlike Bragg, who searched for a crime to pin on his target, Willis is investigating serious misconduct and can argue that she is motivated by Trump’s actions rather than his political affiliation. However, similar to the federal case brought against Trump by special counsel Jack Smith, Willis faces challenges in proving that Trump’s actions constitute criminal offenses. Smith’s charges involve election interference in multiple battleground states, including Georgia, but he must stretch the law to make them stick. Willis, on the other hand, can rely on Georgia state laws specifically designed to address election interference. She may even invoke the state’s anti-racketeering law to depict Trump and his campaign as part of a larger criminal enterprise aimed at corrupting the election outcome. While Willis’s case may be more straightforward than Smith’s, it remains to be seen whether she can convince a jury to convict Trump. One thing is certain, however: if Trump were to win the 2024 election, he would not be able to pardon himself from the Georgia prosecution.
