Jury selection in the first Georgia election subversion trial will commence as scheduled on Friday, following the judge’s rulings on Tuesday which denied attempts to dismiss the charges.
The presiding judge in the Fulton County Superior Court, Scott McAfee, rejected eight motions from Kenneth Chesebro and Sidney Powell, co-defendants who are pro-Donald Trump lawyers and the first to face trial.
Chesebro is accused of planning the fraudulent electors scheme, while Powell faces charges for her involvement in breaching the Coffee County voting system. They were selected as the initial defendants to stand trial as they invoked their right to a speedy trial.
Despite multiple attempts, the defendants were unsuccessful in their bid to have the case dismissed. Both Chesebro and Powell have pleaded not guilty.
In a comprehensive 18-page ruling, Judge McAfee dismissed the defendants’ arguments that the Fulton County prosecutors had misconstrued Georgia’s anti-racketeering law and that the indictment failed to establish crucial elements of the charges brought against them.
McAfee stated, “The Court finds that the indictment contains the necessary elements of each offense and sufficiently apprises the defendant of what she must be prepared to meet at trial.”
Jury selection is slated to begin on Friday.
About 900 residents of Fulton County have been summoned for the jury selection process, and the judge announced on Monday that potential jurors will be informed about the expected duration of the trial, which is approximately five months.
The trial is expected to coincide with the initial months of the 2024 GOP primaries, including the Iowa caucuses in January, Super Tuesday in early March, and potentially the Georgia primary on March 12.
The trial schedule for Donald Trump has not been set yet. However, one defendant, bail bondsman Scott Hall, has already pleaded guilty and agreed to testify for the prosecution during the trials.
