Full Text of Sotomayor and Jackson’s Dissents in Supreme Court’s Affirmative Action Ruling

In a groundbreaking decision, the Supreme Court has rejected affirmative action in higher education, leading to strong dissents from Justices Sonia Sotomayor and Ketanji Brown Jackson, who are part of the court’s liberal wing.

The court’s conservative majority ruled that race-conscious admissions programs at Harvard College and the University of North Carolina are unconstitutional, effectively prohibiting colleges and universities from using race as a factor in their admissions decisions.

Chief Justice John Roberts, the author of the majority opinion, stated that universities can still consider a student’s discussion of how race has affected their life, such as in application essays.

The Supreme Court split along ideological lines in the cases involving Harvard and the University of North Carolina, with Ketanji Brown Jackson not participating in the consideration of the Harvard dispute.

In their dissenting opinions, both Justice Jackson and Justice Sotomayor strongly criticized the decision made by the conservative majority. Jackson denounced the majority’s decision as “colorblindness for all” and argued that race remains significant in real life despite being deemed irrelevant in law. Sotomayor warned of the devastating impact this decision will have on the nation, asserting that racial inequality will persist in higher education if it continues to be ignored.
