The prosecutor accuses Eastman of making false claims about election fraud and pushing state legislatures to favor former President Donald Trump. Despite investigations rejecting these claims, Eastman persisted in his efforts. In an email exchange with Pence’s attorney, Eastman privately admitted that his theory had no chance of persuading a court. Despite this knowledge, Eastman continued to push his illegal scheme and even suggested that Vice President Pence was responsible for his predicament. Eastman’s lawyer argues that his client was merely engaging in a legal debate and exercising his right to free speech and petition for redress. The lawyer claims that Eastman’s goal was to delay the certification of the votes in order to allow for further investigation of fraud claims. He points to Pence’s previous concerns about voting irregularities as evidence. Eastman’s lawyer also references a conversation between Eastman and Pence’s attorney as a legitimate discussion about the scope of constitutionality. However, the prosecutor challenges Eastman’s credibility by highlighting inaccuracies in his statistics regarding voter fraud. The hearing officer intervenes at times to correct Eastman’s misinterpretation of attorney-client privilege. The hearing will continue with Eastman’s testimony on Wednesday.
