Former Maui Fresh Driver Alleges Wrongful Termination Following Near-Stroke Experience

A lawsuit has been filed by Ariel Alfaro, a former truck driver for Maui Fresh International LLC and Man Staffing LLC, alleging wrongful termination and various labor code violations. The suit claims that Alfaro was fired shortly after management learned of his hospitalization for a potential stroke, without any attempt to engage in an interactive process or provide accommodations for his disability.

The lawsuit states, “Rather than engage in any kind of interactive process with Mr. Alfaro, or even show any concern for an employee who recently underwent a serious medical emergency, defendants terminated Mr. Alfaro’s employment.”

Alfaro is seeking unspecified compensatory and punitive damages. Maui Fresh International LLC has not responded to the lawsuit. It’s important to note that Maui Fresh is based in Los Angeles, with a warehouse in Vernon.

The suit outlines that Alfaro was hired as a truck driver in November 2021 through Man Staffing and was involved in an accident four months later while driving from Anaheim to Los Angeles. Despite reporting the accident to his supervisor, no concern was shown, and Alfaro was only paid for eight hours of work instead of the 15 hours he had worked that day.

In late April 2022, Alfaro experienced fatigue and numbness in his hands while at work, and two days later was diagnosed with an impending stroke at the hospital. However, his supervisor was more interested in obtaining the keys to the company truck rather than showing concern for Alfaro’s condition.

Following his hospital release, Alfaro was put on medical leave until May 1, 2022, with modified duties upon return. However, when Alfaro contacted his boss to inform him of his condition and work restrictions, he received no response. Later that day, Man Staffing called to inform him that Maui Fresh did not want him back at work.

The lawsuit also reveals that Alfaro’s driver’s license was suspended due to Maui Fresh’s failure to report the March 2022 traffic accident to the Department of Motor Vehicles. This suspension caused significant distress and financial burden for Alfaro, as Maui Fresh never reimbursed him for the expenses incurred.
