Florida convict seeks to prevent DeSantis from removing lenient state attorney handling his case

A motion was filed on Wednesday by a convicted felon in Florida, aiming to prevent Governor Ron DeSantis from removing State Attorney Monique Worrell from his case. Governor DeSantis has accused Worrell of being too lenient and failing to adequately prosecute crimes, leading him to replace her with Florida judge Andrew Bain. The felon, Melizaire Dorsica, claims that the executive order removing Worrell is unconstitutional and is requesting the reinstatement of Worrell to handle his case.

Dorsica was convicted of possession of dimethylpentylone, a drug similar to amphetamines, in 2022. He now faces another felony charge for carrying a concealed weapon as a convicted felon, which aligns with the type of defendant DeSantis claims Worrell granted “extremely reduced sentences” to.

The mandatory minimum sentence for Dorsica’s gun charge is three years, a requirement that Worrell’s replacement would likely adhere to. DeSantis cited Worrell’s reluctance to prosecute gun crimes as a key reason for her removal, accusing her of inhibiting or discouraging prosecutors from pursuing appropriate sentences.

Dorsica’s lawyers argue that the executive order violating prosecutorial discretion is unconstitutional. They state, “All of the grievances cited in support of [DeSantis’ order] are attributable to DeSantis’ dissatisfaction with Worrell’s exercise of prosecutorial discretion, not a ‘blanket policy’.”

This is not the first time DeSantis has taken drastic action against a prosecutor in Florida whom he believes failed to fulfill their duties. He previously suspended Hillsborough County State Attorney Andrew Warren in August 2022 for refusing to enforce the state’s abortion ban. The suspension was upheld in court by a federal judge in January.

Worrell has not yet responded to requests for comment from Fox News Digital. However, she did criticize DeSantis’ decision, calling it a distraction from his failing presidential campaign and accusing him of destroying democracy in Florida.
