Elie Mystal Retracts Prediction Regarding Trump’s Legal Future

A prominent legal expert has reversed his previous prediction that former President Donald Trump would avoid trial in the federal election subversion case, acknowledging that recent developments are proving him “gloriously wrong.”

Elie Mystal, an attorney and legal reporter for The Nation, shared that he had reviewed a transcript of U.S. District Judge Tanya Chutkan’s decision to set a trial date of March 4.

“I am starting to worry that I will have to formally admit that I was wrong,” Mystal wrote in a thread on X (formerly Twitter) on Tuesday.

Mystal previously believed that Trump would not face trial before the Republican National Convention, at which point he would be named as their nominee, making it nearly impossible to proceed with the trial before the election. However, Judge Chutkan is defying expectations by treating Trump as a regular citizen.

Mystal acknowledged that the trial start date could still change, but even if it is pushed back to May, there will still be ample time for the trial and conviction before the RNC in July. Judge Chutkan does not appear inclined to grant the extensive delays requested by the defense.

Both the prosecution and Trump’s team had their proposed trial dates rejected by Chutkan. Special counsel Jack Smith suggested a January trial, while Trump’s team wanted it to start in April 2026, more than a year after the next presidential election.

Chutkan emphasized that Trump needs to prioritize the trial and she will not adjust the schedule based on his professional obligations. She compared the situation to a professional athlete on trial, stating that it would be inappropriate to accommodate their schedule.

Mystal admitted that Chutkan’s decision has forced him to reconsider his legal analysis.

“I could shift my stance and say that he won’t be jailed until after the election due to potential appeals,” Mystal continued. “But I didn’t even think he would be brought to trial, and Chutkan is making me owe some dinners across the country.”

“I might still be right in the end, but she’s making me look wrong. Gloriously wrong,” he added.

Trump is currently facing four felony trials with proposed start dates for next year. He has been indicted on a total of 91 criminal counts across federal and state-level cases.

Despite his legal challenges, Trump remains the frontrunner for the Republican presidential nomination, leading his closest rivals by a significant margin in the polls.
