In a rather unusual trademark battle, the phrase “Taco Tuesday” became the subject of dispute. Taco John’s, a chain that held the trademark for decades, faced a challenge from the much larger chain Taco Bell earlier this year, according to the Wall Street Journal. However, Taco John’s, which operates in 20 states, has decided to back down from the legal fight due to its high costs. CEO Jim Creel stated, “It’s just not worth the amount of money it would take to defend it. We’d rather take that money and put it toward a good cause.”

As an alternative to the trademark battle, Jim Creel announced that Taco John’s would donate approximately $100 for each of its restaurants, totaling around $40,000, to the nonprofit organization Children of Restaurant Employees. This organization provides support to the families of industry workers, as reported by Nation’s Restaurant News. Creel has challenged Taco Bell to do the same, but there has been no response from the larger chain, according to CNN. Consequently, Taco Bell is expected to increase its Taco Tuesday promotions, although potentially excluding New Jersey. In that state, the trademark for the phrase is owned by Gregory’s Restaurant & Bar, but Taco Bell intends to challenge this ownership as well.
