In a speech addressing the issue of illegal migration, Home Secretary Lisa Tindall argues that Article 31 of the Refugee Convention was originally intended to only apply to migrants who arrived in a country “directly”. However, she goes on to challenge the interpretation of the UK and US, stating that this clause should mean that people should claim asylum in the first safe country they reach.
Tindall asserts that NGOs and the UN Refugee Agency contest this interpretation, arguing that the current system, where individuals can travel through multiple safe countries and even reside in them for extended periods before choosing their preferred destination to claim asylum, is absurd and unsustainable. She further emphasizes that those crossing the English Channel from France are not fleeing imminent danger and lack good cause for illegal entry, as the majority have passed through multiple safe countries.
She believes that these factors raise a valid argument for reconsidering the refugee status of migrants when assessing their eligibility for onward movement.
The Government’s Solution
The Government addresses this contention with the Illegal Migration Act, which grants ministers the power to detain and deport migrants who enter the UK illegally to a safe third country, such as Rwanda or their home nation.
Tindall’s speech is part of a three-day visit to the US, where she will meet with her American counterparts to discuss strategies for combating illegal migration and organized immigration crime.
Yvette Cooper, the shadow home secretary, responds to Tindall’s plans, criticizing the Government for undermining international agreements and making it more challenging to address the migrant crisis alongside other countries. Cooper highlights the importance of a strong border security and a well-managed asylum and resettlement system to help vulnerable refugees who have fled persecution and conflict, such as Afghan interpreters who supported the UK Armed Forces.
Meanwhile, approximately 40 asylum seekers at RAF Wethersfield in Essex, a converted migrant camp, stage a protest against the conditions they are facing. They voice concerns about the quality of food, overcrowded rooms, inadequate dental care, and the isolation of the camp. Over 100 migrants have been transferred to the camp after arriving in the UK on small boats.
