The case revolves around the takeover of a board overseeing Walt Disney World by the governor, which was seen as a response to Disney’s public disapproval of the “Don’t Say Gay” legislation supported by DeSantis and his fellow Republicans. The appointees of the Central Florida Tourism Oversight District are seeking a summary judgment on five out of the nine counts in their lawsuit.

The lawsuit in question stems from Disney’s alleged removal of powers from the appointees regarding design and construction at Disney World. The governor’s appointees argue that Disney’s agreements with previous board members were made without proper notice, lack authority, and unlawfully delegated government authority to a private entity. Last month, the judge denied Disney’s request for a dismissal, allowing the case to proceed.

The conflict between DeSantis and Disney dates back to when the company publicly voiced its opposition to a state law prohibiting discussions of sexual orientation and gender identity in early grade classrooms. As a response, DeSantis passed legislation that granted him control over the district and appointed new supervisors to oversee the services provided to the theme parks and hotels. However, the authority of these new supervisors was limited by pre-existing agreements between Disney and their predecessors. To address this, DeSantis and Florida lawmakers passed legislation to repeal those agreements.

DeSantis has been using his feud with Disney as a talking point in his campaign for the 2024 GOP presidential nomination, often accusing the entertainment giant of being too “woke.” On CNBC, the governor urged Disney to drop their lawsuit, claiming that he and his allies have moved on from the dispute. Disney, on the other hand, has accused DeSantis of violating their First Amendment rights.
