Denial of Exemption from Anti-Nepotism Law to OHA Trustee

Unfortunately, the first request for an exemption from Hawaii’s new anti-nepotism law, made by Office of Hawaiian Affairs Trustee Brickwood Galuteria, has been denied by the Hawaii Ethics Commission. Galuteria, who supervises his daughter Sommer Soares in his role, has been granted a three-month extension to allow for a smooth transition and compliance with the law. During this time, Soares may choose to pursue a new position within OHA or work under a different supervisor.

Galuteria, who previously served in the state Senate, is committed to following the law and ensuring compliance. However, it is uncertain whether his daughter will continue her employment with OHA after working as his aide since January. Galuteria acknowledges that Soares has excellent qualifications and may have other options within the organization.

Galuteria is the first state employee or elected official to request a good cause exemption under the new anti-nepotism law, which aims to combat corruption, campaign spending, and promote government transparency. While certain exceptions may be granted for health care workers serving together in rural communities, the law generally prohibits the hiring or supervision of relatives by state employees, excluding legislators and members of the state Judiciary.

According to the letter from Robert D. Harris, the Executive Director and General Counsel of the Ethics Commission, the new law is designed to eliminate favoritism, prevent conflicts of interest, maintain public confidence in government integrity, and prevent abuses of power.
