Court Docs Reveal Kevin Costner’s Claim that Estranged Wife Refuses to Vacate

Kevin Costner is seeking a court order to compel his estranged wife, Christine Baumgartner, to move out of their matrimonial home following their divorce, as revealed by Insider.

According to court documents obtained by Insider, despite signing a prenuptial agreement stipulating that she would vacate the property within 30 days in the event of a divorce, Baumgartner, 49, has refused to do so, stating that she will only leave when Costner agrees to certain financial demands.

In his court papers, Costner’s attorney, the renowned divorce lawyer Laura Wasser, alleges that he has already provided Baumgartner with $1 million towards finding a new residence and an additional $200,000 during the early years of their marriage as specified in the prenup.

Additionally, Costner claims to have offered a comprehensive temporary child support package of $30,000 per month and has offered Baumgartner $10,000 to cover her moving expenses. He further asserts that he continues to cover the expenses related to their three teenage children and is working towards establishing a summer visitation schedule.

Costner also accuses Baumgartner of charging $95,000 worth of legal services and a forensic accountant to his credit card without prior notice, according to his divorce filing.

According to the prenuptial agreement, Costner agreed to provide Baumgartner with $200,000 for a down payment on a new home and cover her mortgage, property tax, and insurance for one year.

“Kevin has acted in good faith and has done everything in his power to make the transition as seamless as possible,” states Costner’s court papers. “But Christine refuses to vacate his separate property residence as she agreed she would do in 2004 as a condition of marriage.”

In his filing, Costner opened up about his previous experience of being left without a home after his first marriage ended, expressing his determination to prevent a similar situation in the event of a breakup with Baumgartner. He emphasized the importance of having a place to live and work, particularly since he often travels for filming.

Baumgartner, a former handbag designer, filed for divorce from Costner last month. Their three children are currently aged 13, 14, and 16.

A judge has yet to make a ruling on Costner’s request. Insider has reached out to both attorneys representing Baumgertner and Costner for comments.

Both parties are scheduled to appear in court next month for a hearing on the divorce.
