In 2014, Kesha filed a lawsuit against Gottwald, accusing him of verbal abuse and sexual assault. In the same year, Gottwald countersued for defamation. According to Variety, New York Supreme Court Judge Jennifer G. Schecter issued a decision regarding the defamation claim. The ruling revolved around a private text message that Kesha sent to Lady Gaga in 2006, implicating Gottwald as the alleged rapist of both Kesha and Katy Perry. The judge clarified that there is no evidence supporting the claim that Gottwald raped Katy Perry, and that Perry’s testimony remains unchallenged, as stated by The Washington Post.

In addition, Judge Schecter rejected Kesha’s argument that Dr. Luke is a public figure, making it more challenging for her to overcome the defamation claim. Public figures are required to prove “actual malice” or “gross responsibility” on the defendant’s part when accused of making false claims. On the other hand, non-public figures only need to prove that they were harmed by false claims. Furthermore, Schecter ruled that Kesha must pay $374,000 in royalty payments to Gottwald, who has consistently argued that Kesha fabricated the rape claim to terminate her recording contract with him. The jury still needs to consider Kesha’s allegations of being drugged and sexually assaulted by Gottwald in 2005. Her lawsuit was dismissed in 2016, and her attorneys have stated that they plan to appeal Schecter’s decision, as reported by People.
