Carroll Verdict Was Not a Miscarriage of Justice


Former President Trump’s aspirations for a new trial in the E. Jean Carroll case have been dismissed by a federal judge in New York. In May, Trump was found liable for sexual battery and defamation, resulting in a $5 million damages award for Carroll. According to Judge Lewis Kaplan’s 59-page ruling, the jury’s verdict is affirmed, emphasizing that it was not a miscarriage of justice. The judge stated that there is no valid reason to challenge the jury’s decision on sexual assault damages or Trump’s arguments on defamation damages.


Out of the $5 million, $2 million were compensatory damages for battery. Trump’s legal team contested this amount, arguing that he was only found liable for sexual abuse, not rape, which are categorized as sexual battery under state law but have different definitions. In their submission, Trump’s lawyers mentioned that such abuse could have included groping without causing any diagnosed mental injury to Carroll, negating the justification for a $2 million award.


Judge Kaplan directly addressed this argument in his ruling, noting that the jury did not award more than $2 million for groping Carroll’s breasts through her clothing, as there was no evidence of such behavior. The evidence demonstrated that Trump intentionally and forcibly penetrated Carroll’s vagina with his fingers, causing immediate and enduring physical and psychological harm.
