Bonta Criticizes Murrieta Valley School Board’s Policy of Publicly Revealing Gender

State Attorney General Rob Bonta criticized the Murrieta Valley School Board’s decision to enforce a mandatory gender identity disclosure policy, similar to the one adopted in Chino Valley last month, which prompted a civil-rights investigation.

The newly adopted policy in Murrieta Valley requires school staff to notify parents if a student identifies as transgender. The policy specifies notification when a student:

  • Requests to be identified or treated as a gender different from their biological sex
  • Accesses sex-segregated school programs and activities that do not align with their biological sex
  • Requests to change information in their official or unofficial records

The proposal for this policy came from school board President Paul Diffley and clerk Nicolas Pardue. In an interview with the Los Angeles Times prior to the vote, Diffley expressed his belief that parents have a fundamental right to be informed about anything concerning their child’s mental and physical health during school.

Opponents of the policy argue that it infringes on students’ rights, particularly those who do not feel comfortable discussing gender issues with their parents. Board member Nancy Young, who voted against the policy, called it discriminatory and a violation of state law. She also expressed concerns about the negative impact on the already high suicide rate among transgender students.

In a statement on Friday, Attorney General Bonta criticized the policy, stating that it harms the well-being of LGBTQ+ students. He emphasized the importance of protecting transgender students’ ability to choose when and how they disclose their identity, as they often face harassment and mistreatment both at school and in their communities.

Bonta also announced that his office has initiated a civil-rights investigation into the Chino Valley Unified School District for potential legal violations related to a similar gender identity disclosure policy.
