Biden Administration Refuses Legal Status to Hundreds of Thousands of Migrants Amid Border Worries

President Biden’s immigration advisers have decided not to offer Temporary Protected Status (TPS) to nearly 400,000 migrants due to concerns about an increase in border crossings. The Department of Homeland Security (DHS) had developed a plan to expand the TPS program for migrants from Nicaragua, but ultimately decided against it. Nicaragua has seen a rise in citizens migrating to the U.S. in recent years to escape poverty and government crackdowns. The proposed expansion would have made Nicaraguan migrants eligible for work permits and deportation protections, but the fear of a spike in border crossings led to the decision not to expand TPS at this time. Instead, the administration extended TPS designations for Nicaragua and three other countries sought to terminate by the Trump administration, allowing existing beneficiaries to renew their status but not accepting new applicants. Some officials have expressed concerns that expanding TPS could act as a “pull factor” for unlawful migration. Migrant advocates and Democratic lawmakers argue that TPS redesignations are necessary given the dire conditions in these crisis-stricken countries. The administration has been under pressure to expand TPS eligibility, particularly for migrants from Venezuela. While concerns about potential disruptions at the southern border have been raised, Democratic allies and advocates are pushing for more migrants to be eligible for TPS. There have been record levels of migration from Nicaragua and Venezuela, although illegal entries have dropped significantly this year after certain policy changes. The Biden administration started expelling migrants from these countries and allowing for legal entry under certain conditions. Despite predictions of a spike in border arrivals, crossings have decreased since the end of the Title 42 pandemic-era restrictions.
