AQMD Violations Plague LA City’s Hyperion Treatment Plan

The Hyperion Water Reclamation Plant in Playa del Rey has received a violation notice from the South Coast Air Quality Management District (AQMD) for emitting excessive levels of hydrogen sulfide (H2S). This announcement was made by officials on Wednesday.

AQMD, the regulatory agency responsible for air quality in the Southland counties, conducted fence-line monitoring at Hyperion, which revealed elevated levels of H2S. On June 19, the maximum one-hour average of H2S was recorded at 64.60 parts per billion (ppb), surpassing the facility’s permitted limit of 20 ppb.

Before the violation occurred, Hyperion had notified AQMD that it had temporarily shut down several air pollution control devices, known as scrubbers, for planned maintenance and repairs. Within seven hours, the scrubbers were back in service, and the fence-line monitoring system indicated that H2S levels had returned to normal.

After conducting an on-site inspection, AQMD’s enforcement team discovered additional violations by Hyperion. The plant had failed to comply with recordkeeping requirements outlined in a September 2022 order, and they failed to notify the agency within one hour of detecting the elevated H2S levels.

Hyperion, operated by the city of Los Angeles, is located at 12000 Vista Del Mar in Playa del Rey.

Since July 2021, AQMD has been investigating the plant and has responded to over 5,500 complaints from community members. They have issued approximately 70 violation notices to Hyperion for public nuisance violations under Rule 402, as well as one notice for excess visible emissions under Rule 401 and three violations of permit conditions.

Violation of regulations can result in civil penalties, and companies may choose to implement voluntary measures to reduce emissions and prevent further violations. However, if no settlement is reached, a lawsuit may be filed.
