Nevada Seeks to Codify Abortion Access in State Constitution
Advocates in Nevada are pushing to enshrine abortion access and reproductive rights in the state constitution following the Supreme Court’s overturning of Roe v. Wade. Nevada-based coalition Nevadans for Reproductive Freedom, consisting of Planned Parenthood Votes Nevada, NARAL Pro-Choice Nevada, and the ACLU of Nevada, has submitted a petition to the secretary of state’s office. If they collect enough signatures, the proposed constitutional amendment will appear on the ballot in November 2024 and potentially gain final approval by 2026.
Planned Parenthood Votes Nevada Executive Director Lindsey Harmon stated, “We cannot afford to stand by and allow any further encroachment on the fundamental right of Nevadans to determine their own reproductive lives and care.”
The proposed amendment aims to safeguard Nevadans’ rights to make decisions about all aspects of pregnancy, including prenatal care, childbirth, postpartum care, birth control, abortion, and infertility care. It also allows the state to regulate abortion care after the viability of the fetus, as long as the pregnant individual’s life or health is not at risk.
This effort in Nevada is part of a larger battle over abortion rights, as anti-abortion groups seek to impose nationwide bans. However, voters have consistently shown support for protecting abortion access. Similar constitutional amendments have been passed in California, Michigan, and Vermont. Kentucky and Kansas rejected attempts to limit abortion rights in their state constitutions, and Ohio and Florida are considering similar initiatives.
