Legal Battle Unfolds as Beverly Hills Faces Lawsuit Over Chin Injury Caused by Spike and Inadequate Lighting

A lawsuit has been filed against the city of Beverly Hills on behalf of a young girl from Newport Beach who suffered a chin injury after falling on a shallow light post at the Beverly Canon Gardens in 2022.

The lawsuit, filed in the Santa Monica Superior Court, also names Maybourne Beverly Hills Operator LLC as a defendant. Maybourne Beverly Hills Operator LLC is the company responsible for managing and overseeing the Beverly Canon Gardens. The lawsuit alleges negligence and premises liability, as well as a dangerous condition of public property. It seeks compensatory damages and reimbursement for medical expenses.

In the lawsuit, it is claimed that the lighting fixture on the light post had several spikes on top, posing a potential skewering hazard and an unreasonable risk of harm. The suit argues that the fixture’s low height made it difficult for visitors to see, thereby increasing the likelihood of accidents. It describes the lighting fixture as a “dangerous trap.”
