Lawsuit Alleging Age Discrimination Against Elon Musk’s X Clears Legal Hurdle

In a recent development, a California federal judge has rejected a motion to dismiss a lawsuit accusing X, formerly known as Twitter, of discriminatory practices against older employees when it was acquired by Elon Musk last year. US District Judge Susan Illston stated that the plaintiff, John Zeman, has presented sufficient evidence to establish that older employees were disproportionately affected by the mass layoffs, thus allowing the case to proceed. Zeman alleges that X laid off 60% of workers aged 50 and above, and nearly three-quarters of those above 60, compared to only 54% of younger employees. Judge Illston clarified that federal law prohibits age bias in the workplace and allows plaintiffs to pursue “disparate impact” claims in class action lawsuits, a topic that has caused division among courts. While the judge dismissed the claim that X deliberately targeted older workers for layoffs, she granted Zeman a month to file a revised lawsuit with more details for that particular claim. Shannon Liss-Riordan, Zeman’s lawyer, expressed her contentment with the judge’s decision, stating that it affirms the validity of their discrimination claims. X has not provided any comment in response to this matter. This lawsuit is one of the several legal cases that X is currently facing due to Musk’s decision to reduce Twitter’s workforce by approximately 50% starting from November last year. These cases involve various allegations, such as X laying off employees and contractors without sufficient notice and Musk implementing policies that negatively impacted workers with disabilities by refusing remote work and creating a demanding environment. Alongside this, there are at least two lawsuits claiming that the company owes former employees at least $500 million in severance pay. X has denied any wrongdoing in these cases. Liss-Riordan also represents around 2,000 former Twitter employees who have filed similar legal claims against the company through arbitration.
