More recently, former president Donald Trump has been arraigned and pleaded not guilty to 37 charges, including removing classified documents from government property and misleading investigators about them.

While some have questioned whether Trump is being singled out for political reasons, political analyst Sean Trende argues that a former president should only be charged if individuals who engaged in similar behaviors were also charged. Trump’s alleged actions resemble those of lesser-known officials who have faced charges for mishandling classified information, rather than accidental behavior like that of President Biden, Mike Pence, and Hillary Clinton. Furthermore, Trump’s behavior seems to have been more brazen than that of Deutch and Petraeus.

Legal experts have been largely supportive of the Justice Department’s indictment of Trump for the document case, but less so for the New York case charging him with violating campaign-finance law. While the document case has many analogies, the New York case lacks a clear precedent. As the case develops, the government will begin to reveal its evidence through the discovery process, and pretrial motions will be filed and argued. Trump is determined to fight the battle in the court of public opinion as long as possible.
