Exactly one year ago today (August 29, 2022)… A woman has filed a lawsuit against Uber Technologies Inc., claiming that she was sexually assaulted by a driver after falling asleep in the back seat of his car in 2021. She had requested the ride because she felt it was unsafe to drive herself after drinking with friends.
The plaintiff, known in court as Jane EN Doe, has filed the lawsuit in Beverly Hills Superior Court against the ride-hailing service. The lawsuit includes allegations of sexual battery and assault, gender violence, intentional infliction of emotional distress, and negligence. Doe is seeking unspecified compensatory and punitive damages.
“Uber’s response to the systemic problem of sexual assault and rape against their female customers and passengers has been completely inadequate,” states the lawsuit.
According to the lawsuit filed on Wednesday, thousands of female Uber passengers have been subjected to unlawful sexual misconduct by their Uber drivers, including rape, sexual assault, and physical violence, since 2014.
An Uber representative issued a statement on Monday regarding the lawsuit. “The details reported by the rider are truly horrific,” the statement read. “While we cannot comment on ongoing litigation, we have deactivated the driver as soon as the incident was reported to us and are fully cooperating with the police investigation.”
According to the lawsuit, on August 21, 2021, Doe requested a ride home from Uber after a night of drinking with friends in downtown Los Angeles. The driver stopped about a quarter of a mile away from Doe’s home, entered the back seat, and sexually assaulted the sleeping plaintiff, as stated in the lawsuit.
The lawsuit also claims that Doe continues to suffer from “great pain of mind and body, shock, emotional distress, physical manifestations of emotional distress, embarrassment, loss of self-esteem, disgrace, humiliation, and loss of enjoyment of life.”
