Trump Requests Georgia Court to Disqualify District Attorney and Dismiss Election Report

Former U.S. President and Republican presidential candidate Donald Trump recently filed court documents in Georgia, requesting the disqualification of Fulton County District Attorney Fani Willis from investigating him and the dismissal of the special grand jury report that recommended criminal charges in Willis’ 2020 election interference probe. Trump’s attorneys argued that Willis intended to indict him based on unlawfully obtained evidence. These requests came after two grand juries were empaneled in Fulton County to potentially decide whether to charge Trump and his allies for attempting to overturn his loss to President Joe Biden in Georgia’s 2020 election. It is expected that indictments related to the probe could be issued in August. These newly seated grand juries are separate from the special purpose grand jury that presented a final report last year, most of which remains sealed. Unlike the special grand jury, the recently empaneled grand juries have the power to indict. They will convene twice a week to review various cases and determine whether to proceed with an indictment or drop the case. In March, Trump’s attorneys petitioned Fulton County Superior Court Judge Robert McBurney to quash the special grand jury report and disqualify Willis, but no ruling has been made yet. The attorneys expressed concern that Trump could be indicted before McBurney’s decision. They also argued that Trump’s status as a former president and a 2024 candidate warranted special consideration. While it is unusual to make a request directly to the state’s supreme court, Trump’s lawyers believed his case was extraordinary enough to warrant it. Willis’ office declined to comment on the matter, and Trump’s attorneys did not provide immediate comment on the court filings. In the aftermath of the 2020 presidential election, Trump and his allies made efforts to manipulate the vote tallies in swing states like Georgia, where Biden won by narrow margins. Republicans submitted false certificates claiming Trump’s victory and demanded that fake electors be allowed to cast electoral votes for him. As part of the Georgia probe, Willis granted immunity to at least eight fake electors. If Trump is indicted by a grand jury in Georgia, it would be the third case against him, in addition to his indictments in Manhattan and federal court in Florida for allegedly falsifying business records and mishandling classified documents, respectively. Trump has pleaded not guilty in both cases.
