Supreme Court affirms legality of legislation that prohibits promoting illegal immigration

While a district court upheld the conviction, the Ninth Circuit Court of Appeals ruled in Hansen’s favor, deeming the law on encouragement to be overly broad and in violation of the free speech clause of the First Amendment.

The case involved Republican states attempting to challenge the administration’s narrowed priorities for Immigration and Customs Enforcement. However, the majority opinion, penned by Justice Brett Kavanaugh, asserted that the states lacked standing to challenge the priorities and that such a lawsuit was unprecedented.
