RS Judge Dismisses Lawsuit Over Popular Song by Singer Dua Lipa

A federal judge in Riverside has dismissed a lawsuit filed by members of Artikal Sound System, a reggae band, who claimed that Dua Lipa copied one of their songs for her hit track “Levitating.” The court papers obtained on Friday reveal that U.S. District Judge Sunshine Sykes ruled in favor of Lipa, stating that the band failed to prove that the writers of “Levitating” had access to their song “Live Your Life.” The lawsuit, filed in 2022, alleged that Lipa’s song is a knockoff of their 2017 track.

“Levitating” was included in Lipa’s album “Future Nostalgia,” which won Best Pop Vocal Album at the 2021 Grammys. The British singer performed the song at the awards ceremony, solidifying its international success.

In her ruling, Judge Sykes granted Artikal Sound System an opportunity to submit a new complaint if they wished to pursue further legal action.

The band claimed that “Live Your Life” was commercially released in 2017 through CD Baby and was available on various streaming platforms such as Spotify, Pandora, Apple Music, Amazon, and SoundCloud.

The lawsuit alleged that Lipa and her co-defendants had listened to and copied “Live Your Life” before and during the time they were writing “Levitating.” The reggae musicians argued that the two songs are “substantially similar.” The complaint sought damages and profits resulting from the alleged infringement.

The plaintiffs’ representatives were unavailable for immediate comment.
