Federal prosecutors filed a motion on Friday seeking a protective order that would restrict Donald Trump and his team from discussing his criminal case. This request was prompted by a social media post from the former president in which he warned, “IF YOU GO AFTER ME, I’M COMING AFTER YOU!” A spokesperson for Trump argued that his statement was protected by the First Amendment as political speech and was not related to the criminal case, but rather directed at interest groups.
This request for a protective order comes after Trump pleaded not guilty to charges of orchestrating a criminal conspiracy to overturn the 2020 election results and inciting the January 6, 2021 attack on the US Capitol. Trump also assured the court that he would not intimidate witnesses. In their court filing, the US Justice Department’s special counsel emphasized the importance of imposing restrictions in this case due to Trump’s history of using social media to make statements about individuals involved in legal matters concerning him.
The special counsel’s office requested that Trump’s attorneys be prohibited from sharing copies of grand jury interviews and other sensitive material obtained during the discovery process. They also asked for the protective order to be implemented before Trump’s attorneys had a chance to respond. The judge granted Trump until Monday at 5pm local time to respond to the prosecutors’ request.
Prosecutors cautioned that if Trump were to publicly disclose statements based on the discovery material, it could have a detrimental impact on witnesses and impede the fair administration of justice. In separate criminal cases against Trump, judges have previously warned him about making public comments that could incite violence or civil unrest.
Trump is also facing federal charges in Miami for allegedly hoarding classified documents after leaving office, as well as a potential fourth indictment in Georgia related to his efforts to overturn the 2020 election results. Prosecutors in Atlanta are investigating possible charges of racketeering and state election crimes, including engaging in a conspiracy to commit election fraud.
