Orange County District Attorney Takes On Prosecution of Judge Accused of Murduring His Wife in Anaheim Home – Orange County Register

Officials from the Orange County District Attorney’s Office announced on August 9th that they will be handling the criminal case against Judge Jeffrey Ferguson. Judge Ferguson, a former prosecutor and currently an elected judge, was arrested on August 3rd on suspicion of murdering his wife at their Anaheim Hills home. This case has brought up complex issues regarding which prosecutors will handle the case and where the hearings will take place.

The California Attorney General’s Office has determined that the Orange County District Attorney’s Office does not have a conflict of interest in prosecuting the case. However, local prosecutors have not yet indicated when they plan to file charges against Judge Ferguson or what charges he will face. He was released on $1 million bail on Friday.

According to Mario Mainero, a professor at Chapman University’s Fowler School of Law, the key factor now is practicality rather than whether it is a wise choice or what people will say. He emphasizes the importance of transparency within ethical and legal limits.

The investigation revealed that Sheryl Ferguson, 65, was fatally shot inside their residence, and their adult son made the 911 call. The motive behind the shooting remains unknown, although Ferguson had a permit to carry a gun since 1994.

Investigators found the alleged murder weapon and several other firearms in Ferguson’s house. It is still unclear where his first court appearance would take place, as the presiding judge can transfer the case outside the county if a conflict of interest is determined.

Before becoming a judge, Ferguson spent 31 years as a deputy district attorney in Orange County, while his wife worked for the probation departments in Santa Barbara and Orange County.

The local legal and law enforcement community has been shocked by this incident. Colleagues described Ferguson as a compassionate judge, and there were no outward signs of friction between him and his wife.

It is worth noting that Ferguson had previously been admonished by the state Commission on Judicial Performance for making inappropriate comments on Facebook about a judicial candidate and remaining “friends” with attorneys appearing before him in court.
