On this day, one year ago (June 15, 2022), a 28-year-old probationer was ordered by a judge to stand trial for forcible rape and other felonies, following accusations of sexually assaulting a Banning woman at her apartment.
The accused, Garret Anthony Lopez from Hemet, was arrested in March after the alleged attack took place near Williams Street in the 200 block of North Hargrave Street.
After a preliminary hearing at the Banning Justice Center, Riverside County Superior Court Judge Jorge Hernandez determined that there was enough evidence to proceed with a trial on the rape charge, as well as assault with the intent to commit mayhem and sexual battery.
The judge scheduled a post-preliminary hearing arraignment for June 29, and Lopez’s bail remained at $55,000. He is currently held at the Smith Correctional Facility nearby.
According to the Banning Police Department, in the early morning hours of March 6, the defendant allegedly visited the victim at her residence, with whom he had some familiarity, and carried out the attack. The specific details of the incident were not provided, and the victim’s identity has not been disclosed.
Following the incident, the woman contacted the police, leading to an investigation that resulted in Lopez’s arrest without any resistance the following day at his workplace in Cabazon, as stated by the police.
Court records indicate that the defendant has no previous documented felony convictions. However, he does have two prior misdemeanor convictions for driving under the influence.
